MCYC Guest Policy

Moonshine Cove Yacht Club is formed under the BC Societies Act where members own a license to access the facilities which are shared by its members.  As such the guest policy is maintained by the board for the benefit of all members.  This policy covers guest privileges and access and use of the facilities by those guests.

There are 6 types of guests.  These are:

·        Non-Mudge Island Resident Guests

·        Mudge Island Resident /Property OwnerGuest

·        Direct Family Members of MCYC Members

·        Contractors servicing members boats or the MCYC Facilities

·        Contractors or Employees of MCYC Members

·        Long Term Renters

Access to Facilities

All types of guests will need to be accompanied by the member when accessing the facilities unless permission has been granted by the Board of Directors prior to the unaccompanied access.  The board will not unreasonably deny access to Direct Family Members of Members, Contractors, or Employees of MCYC Members.

All vessels of all guest categories that will be using the docks must carry appropriate third party liability insurance to protect the facilities and other member and guest vessels using the marina.  The guest will be required to provide proof of insurance upon request or will need to cease using the facilities immediately except under the provisions of safe harbor.

Guest Parking

There is no guest parking at MCYC.  Only Member Vehicles may park at MCYC.   Guests may access the facility for the pick up or drop off but shall not use any of the parking stalls. Only vehicles owned by MCYC Members may park at MCYC

Additional Regulations & Policies

All guests must comply with the Regulations for the Works and Property of Moonshine Cove Yacht Club.  It is the guests’ host member that is responsible to ensure that the guests comply with those regulations and these policies.

Conduct of type all Guests

All Guests must conduct themselves in a manner that does not impede the enjoyment or use of the facilities by MCYC members. If there are incidents that impede enjoyment or use of the facilities of MCYC Members by guests, the guest may be temporarily or permanently denied access to the facilities. At the Board’s discretion, the host member may be fined or have their access to the facilities suspended.

You and your guests must comply with all applicable Federal, Provincial and Municipal laws or regulations Please see your license agreement.

Contractors Servicing Boats

Contractors who are servicing boats of members must be registered with the wharfinger and unless the wharfinger is informed  and approved prior to commencing work, the contractor will need to be accompanied by the MCYC Member. 

All Contractors are required to carry Insurance for themselves, their employees and subcontractors as well as necessary liability insurance to ensure that MCYC is not held liable for any damage to the facilities, the environment or  other member’s boats and vehicles. Contractor is required to register and above mentioned proof to the Board or Wharfinger prior to commencing work.

Non registered contractors, friends and neighbors who are assisting the members in launching, maintenance, servicing or repairs of the member’s boat will need to be escorted by the member at all times while they are performing the work.

Mudge Island Resident/Property Owner Guests

Mudge Island Resident/Owner Guests may use the facilities only when accompanied by a member. This access is for the mutual enjoyment of use of the members boat for recreational purposes, such as fishing, diving, boating and is as such not restricted for those purposes.    Members shall not provide taxi service or pick up or drop off services to Mudge Island Resident Guests from the MCYC facilities except on an exceptional basis.

Additionally Members from time to time may invite Mudge Island Resident/Property Owner Guests to use facilities for other non recreational purposes such as shopping and receiving services independently aka drop off and pickup. This is not to exceed 4 times per year. If usage is deemed excessive this could entitlement could be suspended for the member.

Direct Family Members of MCYC Members

For the purposes of this policy Direct Family Members are defined as Parents, Children spouses of adult children, Grand Children Siblings, Uncles, Aunts, Nieces and Nephews are considered Direct Family Members.  Direct Family Members of MCYC Members enjoy the same access to the facilities as members and may use the member’s boat and vehicle.  Direct Family Members must be adequately licensed and insured on that boat and vehicle. 

The family member may use their own boat but it must be registered, insured,  and conform to marina size restrictions. If it is larger than the boat that the member has registered, then the members fees will be increased the following year to represent the larger boat.   The limit of one boat at the dock per licensee will remain in effect

If the direct family members are visiting the island infrequently, the wharfinger or board shall be informed by phone or email in advance. 

If a family member of a member owns a separate property or is a resident of Mudge Island, they will be considered a Mudge Island Resident/Owner Guest for the purposes of these policies and not be considered a Direct family member of MCYC Member 

Contractors and Employees of MCYC Members

With advanced  written permission requested from the board, MCYC Members may request access for their employees or a contractor to access and use the facilities for the purpose of servicing the member’s property or business interest on Mudge Island. The board will not unreasonably withhold that permission. The contractor and employee will be able to use the members boat and vehicle as long as they are appropriately licensed and insured on that boat. 

With advance permission from the board, a contractor or employee may use their own boat. In this situation   The boat  must be registered, insured,  and conform to marina size restrictions. If it is larger than the boat that the member has registered, then the members fees will be increased the following year to represent the larger boat.   The limit of one boat at the dock per licensee will remain in effect.

 Non Member and Member Access to the boat ramp and docks

The MCYC Boat ramp is free of use for members of MCYC.  The board may grant access to the boat ramp to Mudge Island Resident/Owner and Non Mudge Island Residents and will collect fees for that use.

Third Parties may drop off and pick up members at the MCYC dock but neither third parties nor members shall be permitted to pick up Mudge Island Resident/Owners from the dock except in exceptional emergency circumstances or if the third party has made prior arrangements and paid the usage fees.

Long Term Renters

With permission of the board, Members of MCYC may apply for their Long Term Tenant’s use of the facilities for the duration of the tenancy of the members primary residence on Mudge  as long as they are using the members boat and vehicle and as such are appropriately licensed and insured on that boat and vehicle.  If the tenant may apply to have own boat use the facilities.  In this case, the tenants boat must comply with size and insurance requirements of MCYC.  Also during the term of the rental, the members relinquish their rights to use the facilities while they have renters using their membership. Rental agreements must comply with Island trust bylaws.

Guest Boats

Members may request temporary access to the facilities for the boats of Non Island Resident/Owners with the following regulations.  There are times when this will not be permitted and will be denied. 

  • Guest Boats are only allowed to moor at the docks for no more than two consecutive days.
  • Only one guest boat is permitted per licensee at a time.
  • Permission for guest boats must be obtained in advance of your guest arriving at our docks
  • Guest boats may be asked to leave the dock if the presence of the guest boat in any way reduced a members ability to use the facility
  • A Mudge Island contact number must be forwarded to the Wharfinger prior to leaving the dock area.
  • Guest boats must be properly insured and the guest is responsible for any damage that their boat may cause to the facilities or other member boats.
  • A note identifying the owner of the boat, contact number and the License Holder the guest is visiting must be left on the boat prior to leaving the dock area.
  • Guest Boats must be rafted to the License Holders boat.
  •  Guest Boats must not be rafted to any boat other than the License Holder they are visiting without the express and prior approval of the boat owners rafted to
  •  Guest Boats must comply with all posted regulations, particularly the maximum overall 25 ft boat length.
  • Should any question regarding usage of docks, interpretation and or enforcement of guest boat regulations be raised by a licensee holder, the decision of the Wharfinger shall be complied with until such time as a review is undertaken by the MCYC Board of Directors.
  • Island resident/Owner non members boats may be granted access to the docks in the event of an emergency such as a severe storm as long as that access does not limit a members ability to use the facility or cause property damage to the facilities.
